These Terms and Conditions govern the purchase of products promoted and sold on this Site (Products). Before placing an order from www.fiorellarossi.com it is essential that you read the Terms and Conditions carefully as your acceptance of them entails the formation of a contract governed by them. Any amendment to the Contract will become effective upon publication on the Site and will govern all subsequent orders.
The use of our website is permitted to natural persons who have the legal capacity to enter into binding agreements under applicable law and who are acting outside the scope of their business and/or professional activity.
Customers must, where requested, provide their name, surname, date of birth, e-mail and delivery address and all requested personal information which must be true, accurate and up to date. It is forbidden to place orders using the name and/or credentials of another person without the express authorisation of the person entitled. It is also forbidden to purchase products for resale.
Unless otherwise specified or clearly recognisable, all content available on this Site is the property of or provided by the Owner or its licensors.
The Owner takes the utmost care to ensure that the content available on this SIto does not violate applicable law or the rights of third parties. However, it is not always possible to achieve this result.
In such cases, without prejudice to any legally enforceable rights and claims, Users are requested to address their complaints to the contact details specified in this document.
The Owner holds and expressly reserves all intellectual property rights to the aforementioned content.
Users are not authorised to use the contents in any way that is not necessary or implicit for the proper use of the Service.
In particular, but without any exclusions, Users are prohibited from copying, downloading, sharing beyond the limits specified below, modifying, translating, processing, publishing, transmitting, selling, sub-licensing, transforming, transferring/licensing to third parties or creating derivative works from the content available on this Site, from allowing third parties to engage in such activities through their User account or device, even without their knowledge.
Where expressly indicated on this Site, the User is authorised to download, copy and/or share certain content available on this Site solely for personal and non-commercial purposes and provided that the attribution of authorship of the work as well as the indication of any other relevant circumstances required by the Owner is observed.
The limitations and exclusions provided by copyright law remain unaffected.
Placing an order on the site (Conclusion of contract of sale)
In order to make a purchase from our website, the Customer must first place an Order of which, subsequently, he/she will receive confirmation of receipt by e-mail. This confirmation of receipt does not imply acceptance of the Order by the seller, which may, in some cases, be refused due to:
inaccurate, incomplete or fraudulent information concerning identity, age, payment information, billing information or shipping address. In this case, the Customer undertakes to promptly notify Customer Service at info@fiorellarossi.com errors on the site concerning the products ordered (wrong description, wrong price…) the products ordered are out of stock or no longer available there is reason to believe that the purchase is intended for resale of the products.
In cases where one of the above situations occurs we will contact the Customer as soon as possible (in any case within 30 days from the date the order was placed). In cases 2 and 3, the Customer will be refunded any amount already charged for the Products.
Acceptance of the order by the Seller shall take place when the Seller sends confirmation of acceptance of the order to the Customer, usually coinciding with the dispatch of the Products (delivery of the Products to the carrier) . Upon receipt of acceptance by the Customer, the Contract is deemed to be perfected.
Orders may be placed using major credit cards, debit cards or other payment methods made available on the Site (so-called “Payment Methods”).
The Seller shall charge the purchase price (hereinafter referred to as the “Price”) upon acceptance of the Order. However, at an earlier stage than the acceptance of the Order, security checks may be carried out on the Payment Method chosen by the Customer for the Order, i.e. a pre-authorisation or pre-debit for precautionary purposes.
The Seller uses a primary payment gateway to authorise payment of Orders (“Payment Gateway”); accordingly, the Seller does not directly handle any financial information relating to the Payment Method used by the Customer, nor does the Site process any financial information provided for the completion of the Order.
The Payment Gateway protects the details of the credit or debit card used by encrypting sensitive information to ensure that it is transmitted securely. The Site uses Secure Socket Layer (SSL) technology to ensure a higher standard of security on every Order.
In the event of any error, negligence or malfeasance relating to the handling of the transaction associated with an Order by the Payment Gateway and payment intermediary systems, neither the Seller nor the Site shall be liable for such error, negligence or malfeasance.
The Seller reserves the right to cancel a transaction and cancel the relevant Order in the event that fraudulent use of the Payment Method adopted for the Order is reported. Furthermore, the Seller shall not be liable in the event of any fraudulent use of a Payment Method by a third party that is not attributable to its error or negligence.
All prices shown on the site are inclusive of VAT.
Shipping costs (free of charge for Italy), inclusive of VAT, are shown in the Order summary during checkout and are also shown in the Order Confirmation sent to the Customer following acceptance of the Order.
Costs related to customs duties and/or customs operations are calculated after entering the destination country and shown in the Order Summary screen.
Any changes to prices will be effective only from the date of their publication on the Site and without any retroactive effect. Orders already accepted will therefore not be affected.
Without prejudice to the case of a recognisable error pursuant to art. 1431 of the Italian Civil Code, the Seller reserves the right not to accept an Order due to the incorrectness of the Price published on the Site or indicated in the email sent to confirm receipt of the Order, i.e. before its acceptance by the Seller.
On particular occasions such as marketing campaigns, Fiorella Rossi Limited may provide Customers with discount codes and vouchers for the purchase of Products from the Site.
Discount codes and vouchers are NOT redeemable or combinable under any circumstances.
Fiorella Rossi Limited is responsible for any original defect of the Products.
Fiorella Rossi Limited warrants that the Products sold on the Site are free from defects and that: comply with the descriptions provided on the Site are appropriate for the purpose for which goods of the same type are normally used possess the qualities that the Customer may reasonably expect taking into account the nature of the goods.
The Seller cannot guarantee, for technological reasons, the complete fidelity of the colours displayed on the screen with respect to reality.
For the purposes of this Contract, possible marginal differences, due to craftsmanship, between the description on the Site and the actual characteristics are not considered causes of non-conformity of the Product.
The conformity guarantee lasts 2 (two) years from the date of receipt of the Product by the Customer.
The regulations set forth in Articles 129, 130 and 132 of the Consumer Code shall apply to the sale of Products. In the event that a non-conforming Product is delivered, the Customer may request that the conformity of the Products be restored, free of charge, by repair or replacement. Should this not be possible, the Customer shall be entitled to a corresponding reduction of the Purchase Price or to the reimbursement of the Purchase Price and (where incurred) the Shipping Charges.
The Customer shall notify Fiorella Rossi Limited of any lack of conformity of the Products within a period of 2 (two) months from the date on which it discovered the lack of conformity through the Contact Us page on the website.
After receiving the notification from the Customer, the Seller shall contact the Customer to agree directly with the same the modalities for the collection of the Products.
The mere receipt of the Products by the Seller after the activation of the present procedure does not imply, in any way, the acknowledgement of a lack of conformity of the Products, a careful verification by the Seller being necessary.
The action to assert hidden defects shall, in any case, be time-barred within twenty-six months from delivery of the Product.
These Terms and Conditions and the contracts of sale governed by them shall be governed by English law.
All disputes relating to these General Terms and Conditions of Sale and the contracts governed by them shall be heard by the competent Court of the Customer’s place of domicile or residence under applicable law or, at the Customer’s option, the Court of London. This is without prejudice to the possibility of promoting the out-of-court settlement of disputes, as provided for in Articles 66 and 141 of the Consumer Code.

If any provision of this Agreement is held to be unlawful, void or ineffective for any reason, that provision shall be deemed severable from the other provisions of this Agreement and shall in no way affect the validity and enforceability of the remaining provisions of this Agreement.
